DMCA Policy

"5'9 In Cm" respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the "5'9 In Cm" website or other online network that are reported to our Designated Copyright Agent identified in the sample notice below.

Filing a DMCA Notice

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the "5'9 In Cm" site or service by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

  1. Identification of the copyrighted work claimed to have been infringed: Provide a detailed description of the copyrighted work that you claim has been infringed. This could be the URL where the original work is published, or a clear description if it's not online.
  2. Identification of the material that is claimed to be infringing: Provide the specific URL(s) or other specific location(s) on the "5'9 In Cm" site where the material that you claim is infringing is located. Please be as specific as possible to allow us to locate the material.
  3. Contact Information of the Complaining Party: Include your full legal name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief: A statement that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate: And, under penalty of perjury, that you are the owner, or an agent authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.
  6. Electronic or Physical Signature: Provide a physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Filing a DMCA Counter-Notification

If you believe that material you posted on "5'9 In Cm" was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Copyright Agent. To be effective under the DMCA, a Counter Notification must be a written communication provided to our Designated Copyright Agent that includes substantially the following:

  • Identification of the material that has been removed or to which access has been disabled: And the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury: That the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Subscriber's name, address, and telephone number: Provide your full legal name, mailing address, and telephone number.
  • A statement that the subscriber consents to the jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the subscriber's address is outside of the United States, for any judicial district in which the service provider may be found, and that the subscriber will accept service of process from the person who provided the original DMCA notice or an agent of such person.
  • Subscriber's physical or electronic signature.
